rabbi Avigdor miller (rejoice o youth 128-130) all of the main points from our oral tradition are not disputed : most arguments are about minor details of halacha not about the main points about which everyone agrees, many arguments are about cases that occur infrequently these differences of opinions arose largely because of persecution since the sages where not able to clarify every halacha and some halachos where forgotten ( rejoice o youth 133) rambam hilchos mamrim 1:3 דברי קבלה אין בהן מחלוקת לעולם וכל דבר שתמצא בו מחלוקת בידוע שאינו קבלה ממשה רבינו There can never be any difference of opinion with regard to matters received through the Oral Tradition devarim 17:9 And you shall come to the Levitic kohanim and to the judge who will be in those days, and you shall inquire, and they will tell you the words of judgment. טוּבָאתָ֗ אֶל־הַכֹּֽהֲנִים֙ הַֽלְוִיִּ֔ם וְאֶל־הַ֨שֹּׁפֵ֔ט אֲשֶׁ֥ר יִֽהְיֶ֖ה בַּיָּמִ֣ים הָהֵ֑ם וְדָֽרַשְׁתָּ֙ וְהִגִּ֣ידוּ לְךָ֔ אֵ֖ת דְּבַ֥ר הַמִּשְׁפָּֽט devarim 17:11 According to the law they instruct you and according to the judgment they say to you, you shall do; you shall not divert from the word they tell you, either right or left. Abarbanel (in parshat shoftim)- the sanhedrin could ever be wrong . Never was and never will be Why Did hashem make it 2 dimensional? Maharal- in giving of the torah hashem wanted to merge a relationship between his infinite self and our finite slef – this becomes a problema s there is no common ground- in order to unite these 2 diverse sides there needs to be a common ground Rabbeynu nissim in his commentary on rosh hashonna 34a cites rav Hai Gaons comments on rosh hashanna 33b this gemera qoutes 2 rannatic sources each describes a different way of sounding the shofar the gemara continues that rabbi Avahu decreed that we must sound the shofar both ways – one might think because we are not sure what is the correct way we do both. Now if one of them is wrong and the other is right that means a big portion of jews did not fulfill the mitzvah of shofar until this time?! This was asked to Rav Hai Gaon “ is it possible that unitl rebbi Avahu came not all jewry fullfilled the oblogation to sound the shofar? He answered: the teruah sound one says its (3 short blasts and one says its 3 long blasts) each one did it there own way and each one is correct and fullfilled there obligation- both are equally valid teruahs. Eruvin 13b א”ר אבא אמר שמואל שלש שנים נחלקו ב”ש וב”ה הללו אומרים הלכה כמותנו והללו אומרים הלכה כמותנו יצאה בת קול ואמרה אלו ואלו דברי אלהים חיים הן והלכה כב”ה 1) rav Yisroel Salanter and rav Yitzchak Hutner – all opinions are legitimate for study of torah all opinions arrived through proper analysis are subsumed under the title of “torah”- torah not only includes what hashem told moshe and which may have been lost but also all valid attempts to reconstruct that information – these and those means that one who spends his day studying and analyzing the opinions of bes shammai is fullfilling the commandment to study torah , even though bes shammai opinion is not the accepted halacha. 2) when we say Eilu Veilu Divrei Elokim Chaim – they are both true how can something be both impure and pure , allowed and not allowed? Rather both opinions hold valid , but the sages of each generation will decide on majority and set the precedent pesachim 3b and Chullin 63b לעולם ישנה אדם לתלמידו דרך קצרה A person should always teach his student in a concise manner. zevachim 12b-13aRav huna declared that a tanna source for halacha was a kra yesayra ( an extra word indicating a teaching), objections were raised the sage continues that it was a kal vechaomer still objections was raised finally the gemera declares that the source for the tanna was a teaching going back 2 centuries in the time of yaveh ,( he had no scripture to back it up , the gemera asks why did rav huna declare there was a scripturr source? ) The answer to sharpen the students minds Some times what appears as a contradiction really isn’t….
